We are transaction brokers. What does that mean?

If you’ve bought or sold a home in Florida, there’s a good chance you’ve encountered a transaction broker, given that most real estate agents operate in this capacity unless otherwise specified in writing. Transaction brokers play a unique role in the Florida real estate market, providing crucial assistance while maintaining a neutral stance, ensuring they don’t act with partiality toward any involved party. 

The fundamental responsibilities of a transaction broker include honest dealings, meticulous accounting for all funds, and applying a proficient skill set with due diligence throughout the transaction. They are obliged to disclose any facts that might significantly impact the residential property’s value and are not obvious to the buyer. Additionally, they must promptly present all offers and counteroffers unless instructed otherwise by a party in writing.

Noteworthy too is their duty of limited confidentiality, which means they’re bound to safeguard specific information unless a party waives this in writing. This includes avoiding disclosure about the seller accepting a price lower than listed, the buyer agreeing to pay more than their written offer, motivations behind selling or buying, and any party agreeing to financing terms other than those put forward. 

Transaction brokers work to facilitate the closing of a real estate deal, preparing and reviewing contracts, negotiation, managing the closing process, conducting market research and analysis, and representing clients during the closing. This comprehensive approach ensures that the process runs smoothly, despite them not offering advice or influencing the transaction directly.

The transaction broker framework, chiefly represented in Chapter 475, section 278 of the Florida statutes, is pivotal for the majority of real estate transactions that involve an agent in the state. As navigating through real estate processes can be intricate, having an informed, local, and knowledgeable real estate agent becomes an invaluable resource for dealing with nuances related to your local real estate market. Remember, staying informed about the entire real estate process and understanding the roles involved, especially that of a transaction broker, is imperative for a seamless buying or selling experience.
